This Privacy Policy describes how Monkey Moves B.V. ("Monkey Moves", "Company", "we", "us" or "our") collects, uses and discloses your personal data when you use the Monkey Moves Play application (the "App" or "Service"), and explains your privacy rights under the General Data Protection Regulation (GDPR) and other applicable laws.

By using the App, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Interpretation and Definitions

Interpretation

Words with an initial capital letter have specific meanings defined below. These definitions apply regardless of whether they appear in singular or plural.

Definitions

• Account means a unique account created by you to access the App.
• Application (or "App") means the Monkey Moves Play mobile application provided by the Company.

• Controller means Monkey Moves B.V., which determines the purposes and means of the processing of personal data (as defined in the GDPR).
• Country refers to the Netherlands.

Monkey Moves B.V. is the data controller under the GDPR.

3. Types of Data Collected

Parent Data

When using the App, parents may provide the following personal information (not all fields are mandatory):

• Name (optional)
• Email address
• Postal code (optional)
• Date of birth (optional)
• Gender (optional)
• Picture (optional)

Child Data

Parents can create profiles for their children. The following data may be collected per child:

• First name
• Date of birth
• Gender (optional)
• Photo (optional; uploaded by the parent)
• Development (optional; questionnaire data)

The App is intended for parents. Children may view the App together with parents, but the App is not designed for unsupervised use by children.

Usage Data

Usage Data is collected automatically when using the App. This may include:

• Device type, operating system, and IP address
• Browser or app version
• Pages visited and features used
• Time and date of visits, session duration
• Activities logged (e.g. playground visits, walking/cycling to school, physical activities)
• Interaction with features such as Maikai's Magic (AI-generated activities), Stories, Goals, and playground searches

Usage Data is collected through Firebase Analytics and similar tools.

Communication Data

We may collect data when you contact us or receive communications from us, including through our email service provider ActiveCampaign.

4. Legal Basis for Processing

We process personal data under the following legal bases (Article 6 GDPR):

• Consent – when you voluntarily provide information (e.g. optional profile data, child photo, enabling notifications).
• Contract performance – to provide and operate the App and its features.
• Legitimate interests – for service improvement, analytics, and communication, provided your rights are not overridden.
• Legal obligations – where required by law (e.g. to comply with data protection regulations or respond to lawful requests).

5. Use of Personal Data

The Company may use Personal Data for the following purposes:

• To provide and maintain the App and its functionalities.
• To manage your Account and allow you to use features such as activity logging, playground search, and goals tracking.
• To provide activity suggestions, including AI-based suggestions through Maikai's Magic.
• To communicate with parents about app usage, progress, and updates.
• To analyse and improve the App and develop new features.
• To send service notifications, if enabled.
• To ensure security and prevent misuse.
• To comply with legal obligations.
• To use aggregated and anonymised data to generate statistical insights, without identifying individuals.

We do not sell personal data to third parties.

6. Sharing and Disclosure of Personal Data

We may share personal data with trusted service providers who act as data processors:

Processors act only according to our instructions and under strict data protection agreements.

8. Retention of Personal Data

We retain personal data only for as long as necessary to fulfil the purposes described:

• Account-related data is kept for as long as the account is active.
• Upon deletion of an account, personal data will be deleted or anonymised within a reasonable period.

The App may contain links to external websites. We are not responsible for the content or privacy policies of third-party sites. Please review the privacy policies of any external sites you visit.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted in the App and the "Last updated" date revised. For significant changes, users will be notified through the App or by email.
